    1. Acceptance of Terms

    By accessing or using Mevity ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

    2. Eligibility

    You must be at least 16 years old to use Mevity. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.

    3. User Accounts

    • You must provide accurate, complete, and current information when creating an account.
    • You are responsible for maintaining the confidentiality of your login credentials.
    • You agree to notify us immediately of any unauthorised access or breach of security.
    • We reserve the right to suspend or terminate your account if we suspect misuse.

    4. License to Use

    We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Mevity for lawful personal or professional purposes. This license does not grant ownership of any intellectual property.

    5. Prohibited Uses

    You agree not to use Mevity:

    • For unlawful, fraudulent, or malicious purposes
    • To violate any applicable laws, regulations, or third-party rights
    • To upload, share, or distribute malware, spam, or harmful code
    • To attempt to gain unauthorised access to our systems or another user's account
    • To scrape, harvest, or collect data from the Service without written consent
    • To harass, defame, threaten, or discriminate against others

    6. User Content

    • You retain ownership of any content you post or upload to Mevity.
    • By posting, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, store, and distribute your content in connection with the Service.
    • You are solely responsible for your content and agree that it will not violate the rights of others or applicable law.

    7. Intellectual Property

    All content, features, and functionality of Mevity (including trademarks, logos, and software) are owned by Mevity or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute them without prior written consent.

    8. Termination

    We may suspend or terminate your account at any time, without notice, if you violate these Terms or misuse the Service. Upon termination, your right to access Mevity will immediately cease.

    9. Disclaimers

    • Mevity is provided on an "as is" and "as available" basis.
    • We make no warranties, expressed or implied, regarding availability, reliability, or suitability of the Service.
    • We do not guarantee that the Service will be error-free, secure, or uninterrupted.

    10. Limitation of Liability

    To the fullest extent permitted by law, Mevity and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

    11. Indemnification

    You agree to indemnify and hold harmless Mevity, its affiliates, and staff from any claims, damages, liabilities, or expenses arising out of your use of the Service or violation of these Terms.

    12. Governing Law

    These Terms are governed by and construed under the laws of New Zealand, without regard to conflict of law principles.

    13. Changes to Terms

    We reserve the right to modify these Terms at any time. Updates will be posted on this page, and continued use of the Service constitutes acceptance of the updated Terms.

    14. Practitioner Verification & Standards

    All practitioners on Mevity must meet our verification standards:

    • Professional Credentials: Valid licenses, certifications, or qualifications in their field
    • Background Checks: Criminal background verification for safety
    • Insurance Requirements: Professional liability insurance where applicable
    • Ongoing Verification: Regular credential updates and compliance checks
    • Due Diligence: We conduct reasonable verification but cannot guarantee practitioner qualifications or services

    While we verify credentials, we do not guarantee the quality of services. Users are responsible for evaluating practitioners and their services. We reserve the right to remove practitioners who fail to maintain required standards.

    15. Health Information Disclaimers

    IMPORTANT MEDICAL DISCLAIMER:

    The information provided on Mevity is not medical advice. It is only for informational and educational purposes. Instead, Mevity is a platform that seeks to connect users with healthcare professionals. We are also not subject to or compliant with HIPAA. Please contact your healthcare provider to discuss your health concerns, diagnoses, or treatments. In a medical emergency, call 911.

    Platform Role & Limitations

    • Not Medical Advice: Information on this platform is not a substitute for professional medical advice, diagnosis, or treatment
    • Educational Purpose Only: Content is for informational and educational purposes only
    • Emergency Situations: For medical emergencies, call 911 or your local emergency services immediately
    • Professional Consultation: Always consult with qualified healthcare professionals for medical concerns
    • No Doctor-Patient Relationship: Using this platform does not create a doctor-patient relationship with Mevity

    Professional Independence

    The healthcare professionals listed on Mevity are independent practitioners, not employees of Mevity, LLC. Further, the professionals listed on Mevity are subscribers to the Mevity platform. Any opinions, advice, or information expressed by a healthcare professional, specialist, practitioner, or coach utilizing or featured on Mevity are of the professional alone. They do not reflect the opinions of Mevity.

    Practitioners are independent service providers, not employees of Mevity. We are not responsible for their advice, services, or any health outcomes. Users are solely responsible for evaluating practitioners and their services.

    16. Content Moderation & Health Claims

    We moderate content to ensure compliance with health regulations and platform standards:

    • Health Claims: Prohibited unsubstantiated health claims or medical advice
    • False Advertising: No misleading claims about treatments or outcomes
    • Regulatory Compliance: Content must comply with FDA, FTC, and other health regulations
    • User Reporting: Users can report inappropriate content or practitioners

    We reserve the right to remove content that violates these standards or applicable laws. Repeated violations may result in account termination.

    17. Booking & Payment Policies

    Booking and payment terms are as follows:

    • Cancellation Policy: Cancellation terms vary by practitioner (typically 24-48 hours notice)
    • Refunds: Refund eligibility depends on cancellation timing and practitioner policies
    • Payment Processing: Payments are processed through secure third-party providers
    • Disputes: Payment disputes should be resolved directly with practitioners first

    Mevity facilitates bookings but is not responsible for payment disputes between users and practitioners.

    18. Platform Liability & Limitations

    LIMITATION OF LIABILITY: To the maximum extent permitted by law:

    • Service Availability: We do not guarantee uninterrupted service availability
    • Third-Party Services: We are not liable for practitioner services or third-party integrations
    • Data Loss: We are not responsible for data loss due to technical issues or user error
    • Maximum Liability: Our total liability is limited to the amount you paid for our services in the past 12 months, or $100 (whichever is greater)

    Some jurisdictions do not allow liability limitations, so these limitations may not apply to you.

    19. Force Majeure

    We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including:

    • Natural disasters, government-mandated shutdowns, or public health emergencies that prevent normal operations
    • Government actions, regulations, or restrictions that directly impact our ability to provide services
    • Internet outages or technical infrastructure failures beyond our control
    • Acts of terrorism, war, or civil unrest that affect our operations

    We will make reasonable efforts to resume normal operations as soon as possible.
